What is vicarious liability?

Posted on January 5th, 2010 No Comments

Vicarious liability is a type of legal liability in which individuals are liable of torts even if they are not directly involved in the accident.

The most common type of vicarious liability occurs when an employer is liable for an employee’s tort. Proving vicarious liability, however, can be difficult.

For instance, if an employee is using a company car and gets in a wreck, then the company may be guilty of vicarious liability. On the other hand, if an employee is driving a personal car and causes a car accident, then vicarious liability cannot be established.
