Automated defibrillators may save fewer lives

Posted on December 1st, 2011 No Comments

Ten years ago, based on a recommendation by the American Heart Association, hospitals across the country purchased millions of dollars worth of automated defibrillators made to help save lives in the event of a patient going into cardiac arrest.

New research, however, has shown that this equipment may have been a mistake, and that the older, low-tech defibrillators in fact save more lives.  Committee members of the American Heart Association endorsed the new products because they were designed so lesser-skilled hospital employees could operate them.

Chair of cardiovascular medicine at the Cleveland Clinic in Ohio, Dr. Steven Nissen, stated, “Why would we want to dumb things down to a level of having a machine do the thinking for us?”

Washington Woman Files Dog Bite Lawsuit Against Campground Owners

Posted on August 11th, 2011 No Comments

A woman in Washington has filed a dog bite lawsuit against the owners of a West Virginia campground.

According to U.S. District Court for the Northern District of West Virginia documents, Jessica Barker filed the dog bite lawsuit against the owners of a Bruceton Mills, W.V. campground. The lawsuit names Christopher Ogden, Rebecca Ogden, Alyeska Inc., Big Bear Lake Country Store, Big Bear Lake Real Estate, Big Bear Lake Property Owners Association Inc., and Bear Foot springs as defendants.

According to the lawsuit, the Ogdens owned, leased and/or rented a site at the campground. Barker says the family owned a “vicious and dangerous dog.” The lawsuit claims the defendants knew that the dog was violent and that it had previously attacked and bitten, or attempted to attack and bite, other individuals at the campground.

“The dog was known by all Defendants to be aggressive and a danger to Plaintiff and the public,” the lawsuit alleges.

Barker was a guest at the campground on May 21, 2010 when she was attacked and severely bitten by the Ogdens’ dog, the lawsuit says. As a result of the attack, Barker claims she suffered severe permanent injuries, tissue loss to her right forearm, puncture wounds to her left calf, and severe emotional distress. She is seeking an unspecified amount in damages.

$1.7M Settlement in NJ Slip and Fall Lawsuit

Posted on June 24th, 2011 No Comments

A New Jersey woman has settled  a slip and fall lawsuit for $1.7 million.

According to court documents, Tessara Restaurant in Hamilton, New Jersey will pay Cynthia Vena $1.7 million to settle a lawsuit she filed after she fell down the restaurant’s steps in January 2008. Edward Slaughter, Vena’s attorney, said his 59 year-old client slipped off a cement stoop being used as a smoking deck and suffered a skull fracture and a brain contusion that required several surgeries and months of rehabilitation.

As a result of her injuries, Vena cannot work, drive a car, or even leave the house by herself. She requires round-the-clock monitoring.

“Her quality of life has been completely diminished,” Slaughter said. “She used to be a vital person who worked to contribute to the family income. Now she’s completely dependent on her husband.”

Vena’s lawsuit centered on the restaurant’s illegal use of the emergency exit and porch outside as a de facto smoking lounge. The lawsuit also claimed the signal identifying when the door was opening had been disengaged and the porch outside did not meet code requirements.

Staple Center Named in Wrongful Death Lawsuit

Posted on June 3rd, 2011 No Comments

Los Angeles’ Staples Center has been named in a wrongful death lawsuit filed by the family of a toddler who fell to his death from a skybox during a Lakers game last year.

According to Los Angeles Superior Court documents, the family of 2 year-old Lucas Tang claims Anschutz Entertainment Group and L.A. Arena Co. did not warn fans about the “dangerous” design of the luxury boxes in the Staples Center. The Tang family is seeking an unspecified amount of damages and an injunction that would require taller barriers in front of the luxury boxes.

According to the lawsuit, Tang fell between 30 and 50 feet from a third-level luxury box just minutes after the conclusion of the Lakers’ game against Golden State on November 20. Tang suffered massive head injuries and died at a hospital later that night.

The lawsuit claims that “in order to obtain the highest price possible for use of the luxury boxes, the Staples Center designed and maintains the luxury boxes in a dangerous condition.”

Attorney for the Tang family, Scott Wellman, said that “beyond providing some measure of compensation to the grieving family,” the purpose of the wrongful death lawsuit is to “compel Staples Center to prevent similar accidents from happening again, even if installing basic safety features reduces the maximum price it can charge for tickets.”
