NY Court of Appeals Reinstates Dangerous Product Lawsuit

The New York Court of Appeals reinstated a Manhattan man’s product liability lawsuit against the makers of a lye drain cleaner.

According to court documents, Yun Tung Chow was burned and blinded in one eye in 2001 when he used Lewis Red Devil Lye crystals to unclog a floor drain. As Chow poured the product onto the drain, it splashed on his face.

Chow filed a product liability lawsuit against the manufacturer of the lye-cleaner alleging defective design and inadequate warning. The lawsuit was dismissed by a judge before trial.

On Tuesday, however, the state Court of Appeals ruled that New York law requires companies facing defective design claims to prove their product does not present an unreasonable risk of harm to the user. The Court reinstated the lawsuit, which will go to trial later this year.

Dangerous Products: 7 Million Candles Recalled Over Burn Hazard

More than 7 million candles are being recalled due to a possible burn hazard.

According to officials with the Consumer Product Safety Commission, more than 7 million Pacific Trade International Inc. “tea light” candles are being recalled due to a fire and burn hazard. An agency release says the candles feature a clear plastic cup that could melt or catch fire while the candle is in use.

The recall includes candles sold under the Chesapeake Bay Candle and Modern Light brand names. They were sold nationwide at Home Goods, Target, and Wegmans stores from July 2009 and February 2011.

Pacific Trade International has received one report of the plastic cup melting while the candle was in use. No injuries or property damage have been reported.

SpaghettiOs, Marie Callender's Frozen Dinners Recalled

The United States Department of Agriculture announced a recall of both Campbell’s SpaghettiOs and ConAgra’s Marie Callender’s frozen meals.

According to The Los Angeles Times, the Marie Callender’s meals have been linked to cases of salmonella in 14 states. The LA Times writes that, “Twenty-nine people have fallen ill; eight of them reportedly ate the meals in April or May.” All Marie Callender’s meals with the title, “‘Marie Callender’s Cheesy Chicken and Rice White Meat Chicken and Broccoli over Rice Topped with Rich Cheddar Sauce,'” are being recalled.

As the LA Times points out, this is not the first major recall for ConAgra. It was the company that manufactured Peter Pan Peanut Butter.

Campbell’s has also announced a recall of their SpaghettiOs with Meatballs. According to the Times, “after a cooker failed to work properly at one of the company’s Paris, Texas, processing plants. As a result, some of the beef and noodles may have been undercooked, the company said.” The recalled cans are marked “EST4K” and expire between June 2010 and December 2011. No illnesses have been reported so far.
